Stipulations in Legal Zoning Plans

Section 9 (BauGB) and the Land Use Ordinance (BauNVO) form the basis for the provisions in legal zoning plans. That said, the stipulation catalog in section 9 (BauGB) adjudicates definitively for the whole of Germany for which stipulations can be included in the legal zoning plan.

The legal zoning plan can also include stipulations relating to the plot of land with regard to:

  • The type of built use,
  • The density of built use,

  • Basic public amenities and infrastructure,
  • Green and open spaces.

The type of built use determines the manner in which a plot of land can be used, whether, for example, residential buildings, workshops, gas stations or other projects are permissible.

The dimensions of the usage regulates the extent to which a plot of land can be exploited for building purposes, in particular th4 size of the land that can be built on. The number of storeys permitted, and the height of the structure

The stipulations with regard to building method and the land which can be built on regulate the location of the building projects on the plot of land.

The land for basic amenities includes the building plots, for example, for schools and nurseries.

The stipulations in the legal zoning plan can be in diagram and / or text form. Stipulations in diagram form are basically determined by PlanzV, the German decree governing the use of symbols in official plans.
